Mediation Fees


Civil, Commercial and Employment Fees

Members of AMM will normally be prepared to charge fees in accordance with the Ministry of Justice (MoJ) scales for mediations referred through AMM. The MoJ fee scale is subject to change. At the time of the last update of this website the MoJ fee scales were as follows:

Amount in Dispute (Claim plus any counterclaim): Fees per party

£5,000 or less: £100 for a mediation of up to 2 hours; £50 per hour thereafter.
£5,000 to £15,000: £300 for a mediation of up to 3 hours; £85 per hour thereafter.
£15,000 to £50,000: £425 for a mediation of up to 4 hours; £95 per hour thereafter.
Above £50,000: Fees by agreement with the mediator.

Please note that AMM’s members are not obliged to accept a mediation at the MoJ fee scale. If you would like an AMM mediator to accept a mediation at the MoJ fee scale it is your responsibility to check with the mediator whether he/she will adopt the MoJ fee scale for your particular case.

All of the above figures are the fees per party and are subject to the addition of VAT, if applicable. The fees are based on the assumption that the mediation will be concluded on the day it begins - different rates may apply if the mediation is expected to go into a second day or beyond. Preparation time prior to the mediation is included in the above fees. It should also be noted that all incidental expenses such as costs of venue, travel and subsistence would be additional to the above fees.

All AMM members are required to pay an introduction fee to AMM to cover administration costs.

In the event of the mediation being unsuccessful, the costs incurred by each party in relation to the mediation (including each party’s share of the mediator’s fee) will be part of the costs of the dispute. These costs are, therefore, capable of falling within the scope of any costs Order made by the Court in litigation relating to the dispute.

If you cannot afford to pay
If you cannot afford to pay these fees, one of AMM's panel members may be prepared to waive part or all of his/her fee subject to being satisfied that it is appropriate in all the circumstances to do so. You may also consider contacting LawWorks. LawWorks is a charity which aims to provide free legal help to individuals and community groups who cannot afford to pay for it and who are unable to access legal aid.

Workplace Mediation Fees

Workplace mediation fees are agreed with and paid by the employer and are calculated on a time spent basis. The format of a workplace mediation will vary depending upon how ready the parties are to face each other. Mediations that are conducted within a day will be costed according to the mediator's daily rate, which will vary from upwards of £1,000 per day. It is highly typical in workplace mediations for parties to need to spread the sessions out over a number of days. In such cases, the mediator will usually charge by the hour at a fraction of their daily rate.
